TERMS AND CONDITIONS BETWEEN JACKIE HERRERA ART AND THE CUSTOMER:
– The Jackie Herrera Art website is managed in accordance with the rules established herein in the Terms + Conditions and the Privacy Policy. Read them carefully and take note of them. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions of this agreement, you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
– Jackie Herrera Art (and jackieherreraart.com) is a company that offers original artworks and embroidered items. All products may be removed from said website without notice.
– Products and services on jackieherreraart.com may not be changed, published, sold, used to reproduce artworks for financial or notary gain or exploited in whole or in part.
– Complete payment for the entirety of your order must be received before your order can be fulfilled. Failure to provide full payment at checkout will result in a refusal and cancellation of the order in question.
– Your order is only legally binding at the point of postage, Jackie Herrera Art retains the rights to amend or cancel an order before this point. Confirmation of receipt of your order does not constitute said legally binding agreement.
– Whilst the greatest care is taken to correctly and accurately price and represent all content on jackieherreraart.com at point of checkout, if there are any mistakes on price or goods described within an order it will result in the order not being fulfilled until rectified with knowledge of the purchaser.
– Upon use of this website (jackieherreraart.com) all personal information such as your address is editable until the point of clicking ‘Purchase’ at checkout. Once past this point any errors in input of personal data, i.e. addresses, are no longer the liability of Jackie Herrera Art and any incorrectly posted items that need rectifying as a result of this will be done so at the expense of the customer.
RIGHTS TO ARTWORK AND IMAGES
– All images, graphics and artworks are the sole property of Jackie Herrera Art. They are not to be used by any third party unless in receipt of express written permission from Jackie Herrera Art.
– Jackie Herrera Art retains all rights to all Original artworks created until it is purchased at which point the collector receives the rights to display said artwork in their home or business, a right that will be defined by a contract or Certificate of Authenticity in the case of Original Artworks.
– Jackie Herrera Art retains all rights to the images of all the artworks including the rights to share or re-use any images of sold or commissioned artworks unless other wise stated in a contract.
– Jackie Herrera Art reserves all rights to reproduce any and all artwork made, unless the purchaser of said artwork has purchased all rights to the artwork in addition to purchasing the original.
GENERAL CONDITIONS
– We reserve the right to refuse service to anyone for any reason at any time.
– Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service
